I think this mythology - that we're all beyond race, of course our police officers aren't racist, of course our politicians don't mean any harm to people of color - this idea that we're beyond all that (so it must be something else) makes it difficult for young people as well as the grown-ups to be able to see clearly and honestly the truth of what's going on. It makes it difficult to see that the backlash against the Civil Rights Movement manifested itself in the form of mass incarceration, in the form of defunding and devaluing schools serving kids of color and all the rest.

Voting rights expert and legal scholar Pam Karlan reports that as of 2004, there were more black men disenfranchised than in 1870, the year the Fifteenth Amendment was ratified prohibiting laws that deny the right to vote on the basis of race.

Mass incarceration has become normalized in the United States. Poor folks of color are shuttled from decrepit, underfunded schools to brand new, high tech prisons and then relegated to a permanent undercaste - stigmatized as undeserving of any moral care or concern.

My great crime wasn't refusing to represent an innocent man; my great crime was imagining that there was some path to racial justice that did not include those we view as 'guilty'.

Of course it would make far more sense to invest in education and job creation in poor communities of color, rather than spend billions of dollars caging them and monitoring them upon release.

There is a tremendous amount of confusion and denial that exists about mass incarceration today, and that is the biggest barrier to movement building. As long as we remain in denial about this system, movement building will be impossible. Exposing youth in classrooms to the truth about this system and developing their critical capacities will, I believe, open the door to meaningful engagement and collective, inspired action.

To make matters worse, federal drug forfeiture laws allow state and local law enforcement agencies to keep, for their own use, up to 80 percent of the cash, cars, and homes seized from suspected drug offenders. You don't even have to be convicted of a drug offense; if you're just suspected of a drug offense, law enforcement has the right to keep the cash they find on you or in your home, or seize your car if drugs are allegedly found in it or "suspected" of being transported in the vehicle.

We're foolish if we think we're going to end mass incarceration unless we are willing to deal with the reality that huge percentages of poor people are going to remain jobless, locked out of the mainstream economy, unless and until they have a quality education that prepares them well for the new economy. There has got to be much more collaboration between the two movements and a greater appreciation for the work of the advocates in each community. It's got to be a movement that's about education, not incarceration - about jobs, not jails.

Arguably the most important parallel between mass incarceration and Jim Crow is that both have served to define the meaning and significance of race in America. Indeed, a primary function of any racial caste system is to define the meaning of race in its time. Slavery defined what it meant to be black (a slave), and Jim Crow defined what it meant to be black (a second-class citizen). Today mass incarceration defines the meaning of blackness in America: black people, especially black men, are criminals. That is what it means to be black.

For the rest of your life you must check the box on employment applications asking the dreaded question: "Have you ever been convicted of a felony?" And once you check that box, the odds are sky high that your application is going straight to the trash. Hundreds of professional licenses are off-limits to people convicted of felonies.

I hope that we will also take seriously the necessity of building alternative parties, and do that work in our communities of organizing movements of movements, creating safe spaces and sanctuary, coming into dialogue, figuring out what a common platform might be for all of us, and building on the work that is happening elsewhere around the community. Even as we resist Donald Trump, doing so with an eye toward building a truly transformational, even revolutionary movement that can become a meaningful alternative to the Democratic and Republican parties.

By waging the drug war and "getting tough" almost exclusively in the 'hood, we've managed to create a vast new racial undercaste in an astonishingly short period of time.

The nature of the criminal justice system has changed. It is no longer primarily concerned with the prevention and punishment of crime, but rather with the management and control of the dispossessed.

For many, whether they go to prison or not is far less about the choices they make and far more about what kind of cage they're born into.

Most Americans violate drug laws in their lifetime, but the enemy in this war has been racially defined. The fact that more than half of the young black men in any large American city are currently under the control of the criminal justice system (or saddled with criminal records) is not - as many argue - just a symptom of poverty or poor choices, but rather evidence of a new racial caste system at work.

Just providing information about how bad things are, or the statistics and data on incarceration by themselves, does lead to more depression and resignation and is not empowering. The information has to be presented in a way that's linked to the piece about encouraging students to think critically and creatively about how they might respond to injustice, and how young people have responded to injustice in the past.

Now that's hard for many people to believe, given that the media image of a drug dealer is a black kid standing on the street corner with his pants sagging down.

Incarceration rates - especially black incarceration rates - have soared regardless of whether crime has been going up or down in any given community or the nation as a whole.

No other country in the world imprisons so many of its racial or ethnic minorities. The United States imprisons a larger percentage of its black population than South Africa did at the height of apartheid

We must build a movement for education, not incarceration. A movement for jobs, not jails. A movement that will end all forms of discrimination against people released from prison - discrimination that denies them basic human rights to work, shelter and food.

Many offenders are tracked for prison at early ages, labeled as criminals in their teen years, and then shuttled from their decrepit, underfunded inner city schools to brand-new, high-tech prisons.

Sociologists have frequently observed that governments use punishment primarily as a tool of social control, and thus the extent or severity of punishment is often unrelated to actual crime patterns.

What defenders of the system typically fail to acknowledge is that the reason violent offenders comprise a fairly large percentage of the state prison population is because they typically receive longer sentences than non-violent offenders.

What has changed since the collapse of Jim Crow has less to do with the basic structure of our society than with the language we use to justify it. In the era of colorblindness, it is no longer socially permissible to use race, explicitly, as a justification for discrimination, exclusion, and social contempt. So we don't. Rather than rely on race, we use our criminal justice system to label people of color "criminals" and then engage in all the practices we supposedly left behind.

I think that we need to begin talking about what does it mean to create these safe spaces in our communities, to begin welcoming one another into our homes and into our communities when they're returning home from prison, people who are on the streets. We need to begin doing the work in our own communities of creating the kind of democracy that we would like to see on a larger scale.

The United States imprisons a larger percentage of its black population than South Africa did at the height of apartheid. In Washington, D.C., our nation’s capitol, it is estimated that three out of four young black men (and nearly all those in the poorest neighborhoods) can expect to serve time in prison.

The mass criminalization of white men would disturb us to the core.

In my own view, it’s our refusal to deal openly and honestly with race that leads us to keep repeating these cycles of exclusion and division, and rebirthing a caste-like system that we claim we’ve left behind

In a growing number of states, you're actually expected to pay back the costs of your imprisonment. Paying back all these fees, fines, and costs may be a condition of your probation or parole. To make matters worse, if you're one of the lucky few who actually manages to get a job following release from prison, up to 100% of your wages can be garnished to pay back all those fees, fines and court costs. One hundred percent.

The education justice movement and the prison justice movement have been operating separately in many places as though they're in silos. But the reality is we're not going to provide meaningful education opportunities to poor kids, kids of color, until and unless we recognize that we're wasting trillions of dollars on a failed criminal justice system.

The war on drugs has been the engine of mass incarceration. Drug convictions alone constituted about two-thirds of the increase in the federal prison population and more than half of the increase in the state prison population between 1985 and 2000, the period of our prison system's most dramatic expansion.

The War on Drugs, cloaked in race-neutral language, offered whites opposed to racial reform a unique opportunity to express their hostility toward blacks and black progress, without being exposed to the charge of racism.

The prison-industrial complex employs millions of people directly and indirectly. Judges, prosecutors, defense attorneys, prison guards, construction companies that build prisons, police, probation officers, court clerks, the list goes on and on. Many predominately white rural communities have come to believe that their local economies depend on prisons for jobs.

If we continue to tell ourselves the popular myths about racial progress or, worse yet, if we say to ourselves that the problem of mass incarceration is just too big, too daunting for us to do anything about and that we should instead direct our energies to battles that might be more easily won, history will judge us harshly. A human rights nightmare is occurring on our watch.

Eventually [black men] are arrested, whether they've committed any serious crime or not, and branded criminals or felons for life. Upon release, they're ushered into a parallel social universe in which the civil and human rights supposedly won during the Civil Rights Movement no longer apply to them.

The mythology around colorblindness leads people to imagine that if poor kids of color are failing or getting locked up in large numbers, it must be something wrong with them. It leads young kids of color to look around and say: "There must be something wrong with me, there must be something wrong with us. Is there something inherent, something different about me, about us as a people, that leads us to fail so often, that leads us to live in these miserable conditions, that leads us to go in and out of prison?"

Certainly youth of color, particularly those in ghetto communities, find themselves born into the cage. They are born into a community in which the rules, laws, policies, structures of their lives virtually guarantee that they will remain trapped for life. It begins at a very early age when their parents themselves are either behind bars or locked in a permanent second-class status and cannot afford them the opportunities they otherwise could.

One in three young African American men is currently under the control of the criminal justice system in prison, in jail, on probation, or on parole - yet mass incarceration tends to be categorized as a criminal justice issue as opposed to a racial justice or civil rights issue (or crisis).

Yet far from putting any meaningful constraints on law enforcement in this war, the U.S. Supreme Court has given the police license to stop and search just about anyone, in any public place, without a shred of evidence of criminal activity, and it has also closed the courthouse doors to claims of racial bias at every stage of the judicial process from stops and searches to plea bargaining and sentencing.

Private prison companies are now listed on the New York Stock exchange and are doing quite well in a time of economic recession (and depression in some communities). But that's just the tip of the iceberg.

Nationwide about 1 in 7 black men are temporarily or permanently disenfranchised due to felon disenfranchisement laws.

There can be many bars, wires that keep a person trapped. All of them don't have to have been created for the purpose of harming or caging the bird, but they still serve that function.

When young black men reach a certain age - whether or not there is incarceration in their families - they themselves are the target of police stops, interrogations, frisks, often for no reason other than their race. And, of course, this level of harassment sends a message to them, often at an early age: No matter who you are or what you do, you're going to find yourself behind bars one way or the other. This reinforces the sense that prison is part of their destiny, rather than a choice one makes.

Most criminologists today will acknowledge that crime rates and incarceration rates in the United States have had relatively little to do with each other.

If you ask for good schools, you aren't likely to get them. If you ask for jobs or economic investment, you won't get that either. But what we have learned, is that the one thing that poor folks of color can ask for and get are Police & Prisons.

Of course, no one should be trapped in bad schools or bad neighborhoods. No one. But I think we need to be asking a larger question: How do we change the norm, the larger context that people seem to accept as a given? Are we so thoroughly resigned to what "is" that we cannot even begin a serious conversation about how to create what ought to be?

Millions of people are unable to vote due to felony convictions with the highest rates among black men. People in prison are denied the right to vote in 48 states, and while we accept that as normal in the United States, in other western democracies people in prison do have the right to vote.

Defenders of the status quo will often try to mislead the public by saying, "Just look at our state prisons: nearly half of the inmates are violent offenders. This system is about protecting the public from violent crime." This type of statement is highly misleading.

For those who say that the war on drugs and the system of mass incarceration really isn't about race, I say there is no way we would allow the majority of young white men to be swept into the criminal justice system for minor drug offenses, branded criminals and felons, and then stripped of their basis civil and human rights while young black men who are engaged in the same activity trot off to college. That would never be accepted as the norm.

Nothing has contributed more to the systematic mass incarceration of people of color in the United States than the War on Drugs

We have not ended racial caste in America, we have merely redesigned it.

The fate of millions of people—indeed the future of the black community itself—may depend on the willingness of those who care about racial justice to re-examine their basic assumptions about the role of the criminal justice system in our society.

In response to the advocacy of groups like Mothers Against Drunk Driving, most states adopted tougher laws to punish drunk driving. Numerous states now have some type of mandatory sentencing for this offense - typically two days in jail for a first offense and two to ten days for a second offense. Possession of a tiny amount of crack cocaine, on the other hand, was given a mandatory minimum sentence of five years in prison.

Mandatory minimum sentences give no discretion to judges about the amount of time that the person should receive once a guilty verdict is rendered. Harsh mandatory minimum sentences for drug offenses were passed by Congress in the 1980s as part of the war on drugs and the "get tough" movement, sentences that have helped to fuel our nation's prison boom and have also greatly aggravated racial disparities, particularly in the application of mandatory minimum sentences for crack cocaine.

Many people don't realize that financial incentives have been built into the drug war that guarantee that law enforcement will continue to arrest extraordinary numbers of people, particularly in poor communities of color, for minor drug offenses that get ignored on the other side of town.

A new race-neutral language was developed for appealing to old racist sentiments, a language accompanied by a political movement that succeeded in putting the vast majority of backs back in their place. Proponents of racial hierarchy found they could install a new racial caste system without violating the law or the new limits of acceptable political discourse, by demanding 'law and order' rather than 'segregation forever'.

All people make mistakes. All of us are sinners. All of us are criminals. All of us violate the law at some point in our lives. In fact, if the worst thing you have ever done is speed ten miles over the speed limit on the freeway, you have put yourself and others at more risk of harm than someone smoking marijuana in the privacy of his or her living room. Yet there are people in the United States serving life sentences for first-time drug offenses, something virtually unheard of anywhere else in the world.

Today it is perfectly legal to discriminate against criminals in nearly all the ways that it was once legal to discriminate against African Americans. Once you're labeled a felon, the old forms of discrimination - employment discrimination, housing discrimination, denial of the right to vote, denial of educational opportunity, denial of food stamps and other public benefits, and exclusion from jury service - are suddenly legal.

One study conducted in Washington, D.C. indicated that 3 out of 4 black men, and nearly all those living in the poorest neighborhoods could expect to find themselves behind bars at some point in their life.

I think it's critically important for people to understand that this system of mass incarceration governs not just those who find themselves in prison on any given day, but also all those who are in jail, on probation or parole, as well as all those who are just months away from being locked up again because they are unable to find work or housing due to their criminal record.

For African American children, in particular, the odds are extremely high that they will have a parent or loved one, a relative, who has either spent time behind bars or who has acquired a criminal record and thus is part of the under-caste - the group of people who can be legally discriminated against for the rest of their lives. For many African American children, their fathers, and increasingly their mothers, are behind bars. It is very difficult for them to visit. Many people are held hundreds or even thousands of miles away from home.

Our prison population quintupled in a thirty year period of time. Not doubled or tripled - quintupled. We went from a prison and jail population of about 300,000 to now more than 2 million.

What are people released from prison expected to do? How are they expected to survive? Can't get a job, locked out of housing, and even food stamps may be off limits. Well, apparently what we expect them to do is to pay hundreds or thousands of dollars in fees, fines, court costs, and back child support (which continues to accrue while you are in prison).

The system functioned relatively automatically, and the prevailing system of racial meanings, identities, and ideologies already seemed natural. Ninety percent of those admitted to prison for drug offenses in many states were Black or Latino, yet the mass incarceration of communities of color was explained in race-neutral terms, an adaptation to the needs and demands of the current political climate.

In the 1990s - the period of the greatest escalation of the drug war - nearly 80 percent of the increase in drug arrests was for marijuana possession, a drug less harmful than alcohol or tobacco and at least, if not more, prevalent in middle class white neighborhoods and college campuses as it is in the 'hood.

My fear is that we will mistake the brand, the "resistance," for greater unity than actually exists and wind up settling for any Democrat the next time around. We have an opportunity right now to build much greater consensus about the need for a meaningful alternative and building a truly transformational movement, town by town, city by city, that has the potential to help birth truly revolutionary change in this country. That potential exists. We got a glimpse of it when such enthusiasm erupted over a democratic socialist Bernie Sanders running for president.

In the war on drugs, state and state law enforcement agencies have been rewarded in cash by the federal government - through programs like the Edward Byrne Memorial Grant program - for the sheer numbers of people arrested for drug offenses.

Middle-class white children, children of privilege, are afforded the opportunity to make a lot of mistakes and still go on to college, still dream big dreams. But for kids who are born in the ghetto in the era of mass incarceration, the system is designed in such a way that it traps them, often for life.

As a criminal you have scarcely more rights, and arguably less respect, than a black man living in Alabama at the height of Jim Crow. We have not ended racial caste in America; we have merely redesigned it.

A massive new penal system has emerged in the past few decades - a penal system unprecedented in world history. It is a system driven almost entirely by race and class.

Today there are more African-Americans under correctional control, in prison or jail, on probation or parole, than were enslaved in 1850, a decade before the Civil War began. There are millions of African-Americans now cycling in and out of prisons and jails or under correctional control or saddled with criminal records. In major American cities today, more than half of working-age African-American men either are under correctional control or are branded felons, and are thus subject to legalized discrimination for the rest of their lives.

Of course in this age of colorblindness, a time when we have supposedly moved "beyond race," we as a nation would feel very uncomfortable if only black people were sent to jail for drug offenses. We seem comfortable with 90 percent of the people arrested and convicted of drug offenses in some states being African American, but if the figure was 100 percent, the veil of colorblindness would be lost.

The so-called resistance is very broad and we don't agree on everything, but there's a moment of opportunity when people are paying attention. It's time for us to really get serious about political education and about our own moral education in this moment, and to seize this opportunity to organize and be in deep dialogue with a whole lot of people who never even thought about being politically engaged or active before. There's real hope there and real opportunity.

I do believe that something akin to a racial caste system is alive and well in America.

I think first we have to begin by telling the truth, which I think has actually been a big stumbling block. We can look at Donald Trump and see how he lies, but I think we also have to look at some of the lies we've told ourselves and the lies we've accepted and internalized ourselves.

More than 2 million people found themselves behind bars at the turn of the twenty-first century, and millions more were relegated to the margins of mainstream society, banished to a political and social space not unlike Jim Crow, where discrimination in employment, housing, and access to education was perfectly legal, and where they could be denied the right to vote.

In many large urban areas, the majority of working age African American men now have criminal records and are thus subject to legalized discrimination for the rest of their lives. It is viewed as "normal" in ghetto communities to go to prison or jail.

The fact that people of all colors have been ensnared by the drug war helps to preserve the system as a whole from serious critique, as it creates the impression - at a glance - that the war is being waged in an unbiased manner, even when nothing could be further from the truth.

If we want to do more than just end mass incarceration—if we want to put an end to the history of racial caste in America—we must lay down our racial bribes, join hands with people of all colors who are not content to wait for change to trickle down, and say to those who would stand in our way: Accept all of us or none.

We must muster the courage, we must find the will, we must do what is necessary to build a truly transformative movement that will end the history and cycle of caste in America.

We are in a social and political context in which the norm is to punish poor folks of color rather than to educate and empower them with economic opportunity.

Our system of mass incarceration is better understood as a system of racial and social control than a system of crime prevention or control.

My own view - and I'm very open to hearing other perspectives - is that this movement-building needs to begin at home, in local communities. It isn't about trying to launch a brand new national party overnight. It's about people in communities coming together across lines of difference, bringing with them their movements, their families, and coming together and saying, "How can we together build a movement of movements here at home? What would that look like? What do we want to do right here in our communities?"

We're living in a time when so many of the civil rights and social justice organizations are run by lawyers and policy people who are often very disconnected from the communities they claim to represent.

Mass incarceration is the most pressing racial justice issue of our time.

I was inspired by what students have done in some schools organizing walkouts protesting the lack of funding and that sort of thing. There are opportunities for students to engage in those types of protests - taking to the streets - but there is also writing poetry, writing music, beginning to express themselves, holding forums, educating each other, the whole range.

In fact, in some countries there are actually voting drives conducted in prison! But here in the U.S., we seem to take the idea of democracy a bit less seriously and people are denied the right to vote not only when they are in prison, but also upon release in many states.

Public housing projects as well as private landlords are free to deny housing to people with criminal records. In fact, you don't even have to be convicted. You can be denied housing - or your family evicted - just based on an arrest.

Prison guard unions have become the powerful political forces in some states, particularly California.

We would never throw up our hands and say to those white boys - well, too bad, if you had just stayed away from marijuana or not dealt dope to your friends when you were 18 you wouldn't be serving a life sentence in prison right now. You wouldn't be locked out of jobs, unable to even get work at McDonalds. No, instead we'd say, "What's wrong with us as a nation that we would condemn so many of our young men to a life of poverty, exclusion, and scorn simply because they made a few mistakes in their youth?".

The wave of punitiveness that washed over the United States with the rise of the drug war and the get tough movement really flooded our schools. Schools, caught up in this maelstrom, began viewing children as criminals or suspects, rather than as young people with an enormous amount of potential struggling in their own ways and their own difficult context to make it and hopefully thrive. We began viewing the youth in schools as potential violators rather than as children needing our guidance.

The rules and reasons the political system employs to enforce status relations of any kind, including racial hierarchy, evolve and change as they are challenged.

Discrimination in public benefits is also perfectly legal. Under federal law, people convicted of drug felonies are deemed ineligible even for food stamps.

In my view, the critical questions in this era of mass incarceration are: What disturbs us? What seems contrary to expectation? Who do we really care about?

Once you have been branded a criminal or felon, you are typically trapped for life.

People on probation and parole are typically denied the right to vote, and in eleven states people are denied the right to vote even after completion of their sentences.

We have now spent 1 trillion dollars waging the drug war since it began. A trillion. Those funds could have been used for education, jobs and drug treatment in the communities that needed it most. We could have used those funds for our collective well being, instead those dollars paved the way for the destruction of countless lives, families, and dreams.

Defenders of the system will counter by saying this drug war has been aimed at violent crime. But that is not the case. The overwhelming majority of people arrested in the drug war have been arrested for relatively minor, non-violent drug offenses.

Black men in ghetto communities (and many who live in middle class communities) are targeted by the police at early ages, often before they're old enough to vote. They're routinely stopped, frisked, and searched without reasonable suspicion or probable cause.

I think it's critically important that the people who have been most harmed by mass incarceration, by mass deportation, by neoliberalism, by all of it, not only have a voice in crafting these platforms but emerge and are supported as real leaders in these movements.

... as recently as the mid-1970s, the most well-respected criminologists were predicting that the prison system would soon fade away. Prison did not deter crime significantly, many experts concluded. Those who had meaningful economic and social opportunities were unlikely to commit crimes regardless of the penalty, while those who went to prison were far more likely to commit crimes again in the future.

I think it's important to encourage young people to tell their own stories and to speak openly about their own experiences with the criminal justice system and the experiences of their family. We need to ensure that the classroom environment is a supportive one so that the shame and stigma can be dispelled.

For the rest of their lives, [black men] can be denied the right to vote, automatically excluded from juries, and legally discriminated against in employment, housing, access to education and public benefits. So many of the old forms of discrimination that we supposedly left behind during the Jim Crow era are suddenly legal again once you've been branded a felon.

There are more African Americans under correctional control, in prison or jail, on probation or parole, than were enslaved in 1850 a decade before the civil war began.

It's important to teach students about the reality of the system, that it is in fact the case that they are being targeted unfairly, that the rules have been set up in a way that authorize unfair treatment of them, and how difficult it is to challenge these laws in the courts. We need to teach them how our politics have changed in recent years, how there has been, in fact, a backlash. But we need to couple that information with stories of how people in the past have challenged these kinds of injustices, and the role that youth have played historically in those struggles.
